Refund and Withdrawal Policy

This Refund and Withdrawal Policy explains the statutory and voluntary refund options available for paid Lexborn subscriptions and one-time purchases. It supplements the Terms of Service at section 5 and the Privacy Policy. The Service is provided by Bapusaheb Patil trading as Nuits, Y-tunnus 3584845-8 — see /imprint. Payments are processed by Polar.sh as Merchant of Record.

1. EU/EEA right of withdrawal (statutory)

If you are a consumer in the EU or EEA, Directive 2011/83/EU on Consumer Rights ("CRD"), as transposed into Finnish law by the Consumer Protection Act (Kuluttajansuojalaki 38/1978, Chapter 6), gives you a right to withdraw from a distance contract within 14 days of conclusion, without giving any reason.

The Lexborn Service is digital content not supplied on a tangible medium within the meaning of Article 16(m) CRD. The right of withdrawal lapses once performance has begun with your prior express consent and your acknowledgement that you thereby lose your right of withdrawal. Polar.sh, as Merchant of Record, collects this consent and acknowledgement at checkout via tick-boxes that are not pre-ticked. In practice, your statutory right of withdrawal lapses the moment you start your first AI conversation after the purchase.

If you have not yet started your first conversation after the purchase, you may still exercise the right of withdrawal within 14 days by emailing hi@lexborn.app with the subject "Withdrawal" and the email on your account. We will refund the full price within 14 days of receiving the request, using the same payment method as the original transaction unless you agree otherwise.

2. Voluntary refund window (beyond statutory)

Independently of any statutory right, and on a goodwill basis, we offer the following refunds:

2.1 Annual plans

Full pro-rated refund if you request it within 30 days of the original charge or the most recent annual renewal. The refund equals the unused portion calculated to the day. Access to the Service ends on the refund date.

2.2 Monthly plans

Full refund of the most recent month if you request it within 14 days of that monthly charge. Access continues to the end of the period unless you ask us to cut off access immediately.

2.3 Starter Pack (30-minute, 30-day, one-time)

Full refund within 14 days of purchase only if no minutes have been consumed. Once any minute has been used, the Starter Pack is non-refundable, because the digital content has begun to be supplied. We strongly recommend you make sure your microphone and headphones work before starting your first session.

2.4 Promotional credits and free-tier minutes

Promotional credits, free-tier minute pools, and gifted minutes are not refundable for cash because they were not paid for in cash.

3. How to request a refund

You can request a refund in two ways:

  1. Polar customer portal. Sign in via the customer-portal link in any Polar invoice email and choose "Request refund". This is usually the fastest route.
  2. Email us. Send a message to hi@lexborn.app with the subject line "Refund request" containing the email address on your Lexborn account, the approximate date of the charge, and a one-line note about why. You do not need to give a detailed reason; we ask only so we can fix systemic issues.

For chargebacks initiated through your card issuer, please contact us first — we can usually resolve the issue faster and without hurting your chargeback record.

4. Processing time

Once a refund is approved, we instruct Polar to issue it within 14 business days. The time it takes to land in your account depends on your payment method and bank: card refunds typically settle in 5–10 business days; SEPA, ACH, and wire refunds 3–7 business days; PayPal usually within 24 hours.

5. Disputed charges and chargebacks

Polar.sh, as Merchant of Record, is the counterparty for chargeback purposes and handles them under the relevant card-network rules. We coordinate with Polar on the substantive merits of any dispute. If you believe a charge is fraudulent or that your card has been used without authorisation, contact your bank immediately and email us at hi@lexborn.app so we can disable the affected account and assist the investigation.

6. California Automatic Renewal Law (ARL)

For California residents, in compliance with the California Automatic Renewal Law (Cal. Bus. & Prof. Code §§17600–17606):

  • You may cancel any time from Settings → Billing in the app or via the Polar customer portal. Cancellation takes effect at the end of the current billing period and you retain access until then.
  • We send a pre-renewal reminder email before each annual renewal containing the renewal date, the price, the cancellation method, and a one-click cancel link.
  • You will see clear and conspicuous disclosure of the auto-renewal terms at checkout, including the recurring nature of the charge, the amount, the frequency, and the means to cancel.
  • You may cancel by responding to any renewal-reminder email with the word "cancel".

7. Germany — BGB §309 Nr. 9 (monthly cancellation after first year)

For consumers in Germany on annual or longer subscription terms, after the first contractual year has elapsed you may terminate the subscription with one month's notice to the end of any month, in line with §309 Nr. 9 BGB as amended. To exercise this right, email hi@lexborn.app or use the Polar customer portal. This right is in addition to, and does not replace, any other cancellation right.

8. Faulty service / non-conformity

If the Service does not conform to the contract — for example, if a defect on our side prevented you from using the time you paid for — we will, at our option and at no charge to you, restore service, extend your subscription by an equivalent amount, or refund the affected portion. This right is in addition to your statutory non-conformity rights under the Finnish Consumer Protection Act and Directive (EU) 2019/770 on contracts for the supply of digital content and digital services.

9. Changes to this policy

If we change this Refund and Withdrawal Policy, we will update the "Last updated" date and, where the change is material, give at least 30 days' notice by email to active subscribers. Pre-existing refund rights you accrued before a change are honoured under the version of the policy in force at the time of your purchase.
